Terms and Conditions

 

TERMS AND CONDITIONS

The conclusion of an agreement between the Buyer and the Seller may occur in two ways. Prior to placing an order, the Buyer has the right to negotiate any provisions of the agreement with the Seller, including changes to these Terms and Conditions. Such negotiations should be conducted in writing and addressed to the Seller (Crafdeco sp. z o.o., Nowy Świat 1, 33-130 Radłów, Poland). If the Buyer waives the possibility of concluding an agreement through individual negotiations, the following Terms and Conditions and relevant legal provisions shall apply.

§1 Definitions

  1. Personal Data Administrator: Crafdeco sp. z o.o., Nowy Świat 1, 33-130 Radłów, KRS: 0001124850, REGON: 529538939.

  2. Postal Address: Name and surname or institution name, location (street, building number, apartment/local number, zip code, and city).

  3. Address for Complaints: Crafdeco sp. z o.o., Nowy Świat 1, 33-130 Radłów, Poland.

  4. Delivery Price List: A summary of available delivery methods and their costs available at https://crafdeco.com/strona/formy-i-koszty-dostawy.

  5. Contact Details: Crafdeco sp. z o.o., Nowy Świat 1, 33-130 Radłów; e-mail: [email protected]; phone: 697-278-041.

  6. Personal Data: Any information relating to an identified or identifiable natural person.

  7. Sensitive Data: Personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, health data, etc.

  8. Delivery: The type of transport service, including the carrier and cost, as specified in the delivery price list.

  9. Proof of Purchase: An invoice, bill, or receipt issued in accordance with the Goods and Services Tax Act.

  10. Product Card: An individual subpage of the Store containing information about a single product.

  11. Client: A natural person conducting business, a legal person, or an organizational unit with legal capacity, concluding an agreement for professional purposes.

  12. Consumer: A natural person concluding an agreement for purposes not directly related to their professional activity.

  13. Cart: A list of products compiled from the Store's offering based on the Buyer's choices.

  14. Buyer: Refers to both the Consumer and the Client.

  15. Place of Delivery: The postal address or pick-up point indicated in the order.

  16. ODR Platform: The EU online service for dispute resolution available at https://webgate.ec.europa.eu/odr.

  17. Payment: The method of paying for the subject of the agreement and delivery.

  18. Privacy Policy: The rules for processing personal data by the Administrator, available at crafdeco.com/polityka-prywatnosci.

  19. Product: The minimum and indivisible quantity of an item that may be the subject of an order.

  20. Store: The online service available at crafdeco.com.

  21. Seller: Crafdeco sp. z o.o., Nowy Świat 1, 33-130 Radłów, NIP: 8733298040, REGON: 529538939, KRS: 0001124850. Bank Account: 70 1140 2004 0000 3602 8524 8261.

  22. Lead Time (Delivery Time): The number of hours or working days specified on the product card.

  23. Defect: A physical or legal defect of the item.

§2 General Conditions

  1. The agreement is concluded in Polish (or English as translated), in accordance with Polish law and these Terms.

  2. The place of delivery must be within the territory of the Republic of Poland.

  3. The Seller is obliged to provide products free from defects.

  4. All prices are in Polish Złoty (PLN) and include VAT. Prices do not include delivery costs.

  5. All deadlines are calculated in accordance with Art. 111 of the Civil Code.

  6. The Seller confirms and secures the terms of the agreement by sending the Buyer an e-mail with the order confirmation, invoice, and relevant PDF attachments (Terms, withdrawal form).

  7. The Seller shall not charge any additional fees for remote communication beyond the rates of the Buyer's service provider.

  8. The Buyer is obliged to provide truthful data and use the Store in a manner consistent with the law and "netiquette" (no spam, no prohibited content).

§3 Conclusion and Fulfillment of the Agreement

  1. Orders can be placed 24 hours a day.

  2. To place an order, the Buyer adds a product to the cart, selects the delivery and payment methods, and confirms the purchase via the "I buy and pay" button.

  3. Consumer Agreement: Concluded at the moment the order is placed.

  4. Client Agreement: Concluded at the moment the Seller accepts the order (within 48 hours).

  5. Fulfillment begins after the payment is credited (for prepayments) or immediately (for cash on delivery).

  6. Shipment occurs within the timeframe specified on the product card.

§4 Right to Withdraw from the Agreement

  1. A Consumer has the right to withdraw from a distance agreement without giving a reason within 14 days of receiving the item.

  2. To meet the deadline, it is sufficient to send a statement before its expiry.

  3. The Consumer must return the item at their own expense within 14 days of withdrawal.

  4. The Seller shall refund all payments, including the cheapest ordinary delivery cost, within 14 days of receiving the withdrawal notice (but may withhold the refund until the item is returned).

  5. Exceptions: The right of withdrawal does not apply to custom-made products (non-prefabricated, made to specifications), perishable goods, or sealed goods opened after delivery (hygiene/health reasons).

§5 Warranty (Rękojmia)

  1. For Clients: Liability under the warranty for physical and legal defects is entirely excluded (Art. 558§1 of the Civil Code).

  2. For Consumers: The Seller is liable for defects under the rules of the Civil Code.

  3. If an item has a defect, the Consumer may request a price reduction, withdraw from the agreement (unless the Seller immediately replaces/repairs it), or demand replacement or repair.

  4. The Seller is liable under the warranty if a physical defect is found within two years from the date of delivery.

  5. Complaints are considered within 14 days (for specific demands) or 30 days (for other statements).

§6 Privacy and Data Security

  1. The Personal Data Administrator is responsible for the lawful processing of data.

  2. Data (address, e-mail, phone) is collected only to the extent necessary to fulfill the order.

  3. Detailed provisions are contained in the Privacy Policy.

§7 Final Provisions

  1. None of these provisions aim to violate the Buyer's rights. In case of conflict with applicable law, the law prevails.

  2. Registered Buyers will be notified of changes to the Terms at least 30 days in advance via e-mail.

  3. In case of disputes, the Consumer may use out-of-court settlement methods (ODR platform, mediation via Trade Inspection).

  4. Matters not regulated herein are governed by relevant Polish legal provisions.
